WISCONSIN Insurance Commissioner Ted Nickel lack of public information has dubbed his behavior as "Depraved Indifference"


MILWAUKEE - (MPA-PPR), Sunday's Alert, October 21, 2012, after WI Commissioner of Insurance Ted Nickel did not provide "requested" public information that would answer questions that would show that the joint efforts of WI Office of Commissioner of Insurance working with Secretary Dennis Smith, Department of Human Services and Secretary Reggie Newson, Department of Workforce Development, were providing expected preparedness for Wisconsin Affordable Health Care Exchange; his behavior was was citizen-cited by Mary Glass, Chair/CEO, Milwaukee Professionals Association, as "depraved indifference". 

The Commissioner was given another opportunity to take his Oath, the People's law - Affordable Health Care Act and over 5,700,000 Wisconsinites health exchange seriously.

The request was made by Glass after she read online the Commissioner's letter to Secretary Kathleen Sebeluis, U. S. Health and Human Service, stating why he was not submitting the EHB/Essential Health Benchmark report by September 30, 2012.

Depraved Indifference is defined by US Legal as:

The Depraved Indifference - To constitute depraved indifference, the defendant's conduct must be 'so wanton, so deficient in a moral sense of concern, so lacking in regard for the life or lives of others, and so blameworthy as to warrant the same criminal liability as that which the law imposes upon a person who intentionally causes a crime. Depraved indifference focuses on the risk created by the defendant’s conduct, not the injuries actually resulting.

The Depraved Indifference Complaint was sent on October 19, 2012 in a formal online and extended version email complaint.

It spoke of Commissioner Nickel's behavior being detrimental to the health welfare of 5,700,000 Wisconsinites by refusing to provide public information requested - public information to educate Milwaukeeans in  Milwaukee Professionals Association LLC 3-part Affordable Health Care briefings for "patient-centered" Affordable Health Care act; and, public information in the form of a status report - transparency, best practices and accountability.

It spoke of Commissioner Nickel not honoring his Oath of Office (date-stamped by the WI Secretary of State, January 10, 2011.

It spoke of Commissioner Nickel not honoring WI State Statute 601, especially WI State Statute 601.01(10).

It allows Commissioner Nickel to reconsider and provide requested answers.

"Since we were aware that certain action steps must be completed over the next 14 months for full emplementation by the state; and, since we knew that Governor Scott Walker has a political 'stall' on the Affordable Health Care Exchange process, the concern was that Commissioner Nickel, Secretary Smith and Secretary Newson were more concern about the stall than the health welfare of the 5,700,000 Wisconsinites or satisfying Oath of Office that calls into account both the U.S. Constitution and Wisconsin Constitution," said Glass.
